Q: I have a 12 month lease in an apartment which ends this August. And I want to leave before the lease ends. (Which is 2 months before the lease ends on end of May) I did contact my landlord by phone like a month before that I will be moving out and he told me that I can leave but he has to find people to fill in the apartment by June 1st.
So he posted the ad on this website... And he still hasn't found people. It's almost June and I will be leaving within this week and he says I still have to pay for June since he hasn't found people yet.
Now my main question is.. is it really my job to find the new tenants? He's not even trying to find tenants because he's picky and just tries to find student tenants not just anyone and wont even post it on Craig list or anything. He doesn't even want to make a deal with me and my roommates to pay just half the June month. Is this right that I have to pay even though I won’t be living here and I did notify him early?? I really want my deposit back too. Overall he's being an asshole saying that he has his own bills to pay and that he can't find people so I still have to pay because the lease didn't endow... and I'm in New York State.
The best answer: He is under no obligation to make a deal with you!! YOU are the one breaking the lease!
The amount of notice and the actual vacate date has nothing to do with anything when you are breaking the lease. Even if you were not breaking a lease, it is still legally required to pay rent through the full notice weather you are there or not.
You are not getting your deposit back. You typically lose your deposit when you break a lease.
He is not doing anything wrong here. Everything he is asking of you is legal. You have no law on your side.
